15. Business Ownership

Zaptecs Pest Control is owned and operated by Jordan Michael Simale LLC, doing business as (DBA) Zaptecs Pest Control. All contracts, services, and communications are conducted under this legal business entity.

Service Agreement

1. GENERAL PROVISIONS

This Service Agreement (“Agreement”) is made between Jordan Michael Simale, LLC, doing business as Zaptecs Pest Control (“Company”, “we”, or “us”), and the “Client” (the customer receiving services). This Agreement governs all pest control services rendered and is enforceable upon verbal or written authorization or upon granting our technician access to the premises. Services provided by Zaptecs Pest Control are subject to the terms below and any additional written agreements signed by both parties.

 

 

2. LICENSE & COMPLIANCE

Zaptecs Pest Control operates under full licensure in accordance with applicable local, state, and federal regulations. All pesticides applied are EPA-registered and used in accordance with label directions and industry best practices. Our technicians are licensed, insured, and trained in Integrated Pest Management (IPM), ensuring environmentally conscious and minimally invasive treatments.

 

 

3. SCOPE OF SERVICES

Services provided may include, but are not limited to:

Interior and exterior pest inspections

Treatment for ants, roaches, spiders, silverfish, wasps, rodents, fleas, ticks, and other common household pests

Application of chemical and non-chemical methods (sprays, dusts, baits, gel applications, traps)

Exterior perimeter treatments and barrier control

Rodent exclusion and monitoring devices

Seasonal and ongoing maintenance visits

Recommendations for exclusion, sanitation, and environmental corrections

NOTE: Services do not automatically include termites, bed bugs, wildlife removal, or specialty pests unless specifically stated in a written addendum.

 

 

4. MATERIALS USED & SAFETY GUIDELINES

All pesticides used are selected for effectiveness and low environmental impact. A list of active ingredients and EPA Registration Numbers is provided on the invoice. Clients may request Safety Data Sheets (SDS) for any product used.

Safety Obligations of the Client:

Keep pets, children, and vulnerable individuals away from treated areas until they are dry or as instructed by the technician

Remove or cover food, dishes, utensils, and aquariums before interior treatments

Avoid touching or tampering with bait stations, traps, or chemical residue

Zaptecs Pest Control will not be liable for reactions or side effects caused by improper handling of treated areas by the client or other occupants.

 

 

5. ACCESS REQUIREMENTS

Client must provide access to all areas requiring treatment at the time of service. Locked doors, cluttered spaces, or hazardous conditions (e.g., aggressive pets, construction, infestations) may prevent service completion.

If access is denied or the technician is unable to complete the job due to the client’s failure to prepare the space as instructed, a rescheduling fee of $20 may be charged.

 

 

6. SERVICE FREQUENCY, GUARANTEE & EXCLUSIONS

Service Frequency:

Services may be provided on a one-time, monthly, bi-monthly, or quarterly basis. Any ongoing services will be scheduled and agreed upon in writing. Automatic renewals may apply to maintenance plans unless canceled per the cancellation policy.

Guarantee:

Zaptecs Pest Control offers a 30-day service guarantee for general pest treatments. If the same pest problem recurs within 30 days, we will return for one free re-treatment.

Exclusions from Guarantee:

Pest issues not reported within the guarantee window

Structural or environmental conditions that prevent effective treatment (e.g., hoarding, water damage, poor sanitation)

Termites, bed bugs, bees, or wildlife unless specified in a specialized agreement

Rodent re-entry due to failure to seal up entry points

Zaptecs Pest Control reserves the right to deny a guarantee if the client fails to follow our technician’s sanitation or exclusion recommendations.

 

 

7. CLIENT RESPONSIBILITIES

The Client agrees to:

Follow preparation instructions before and after service

Maintain a clean and structurally sound environment

Report pest sightings or concerns promptly

Avoid the use of over-the-counter pesticides, which can interfere with our treatment plan

Avoid disturbing or disposing of professional bait stations or traps

Failure to meet these responsibilities may void the guarantee and impact treatment success.

 

 

8. PAYMENT TERMS

All invoices must be paid within 7 days of service unless otherwise agreed in writing.

Accepted payment methods: cash, check, credit card, Venmo, Zelle.

Late payments are subject to a 1.5% monthly interest charge or $20 minimum late fee, whichever is greater.

Returned checks will incur a $30 NSF fee.

Ongoing services may be suspended until the account is brought current.

Zaptecs Pest Control reserves the right to pursue collections or legal action for unpaid invoices, including recovery of costs and legal fees.

 

 

9. CANCELLATION & RESCHEDULING POLICY

Services may be canceled or rescheduled at least 24 hours in advance without penalty.

Same-day cancellations or failure to be present may result in a $30 no-show fee.

For recurring service plans, cancellation must be submitted in writing at least 15 days prior to the next scheduled treatment.

Zaptecs Pest Control may cancel or refuse future service if the client is found to be non-compliant, abusive, or consistently delinquent in payments.

 

 

10. DAMAGE & LIABILITY DISCLAIMER

Zaptecs Pest Control is not responsible for:

Pest damage that occurred before our services began

Property damage resulting from failure to follow treatment prep or post-care instructions

Damage caused by pests that re-enter due to unresolved structural issues

Incidental or consequential damages caused by pests or chemicals when services are refused, canceled, or improperly followed

The total liability of Zaptecs Pest Control for any cause shall not exceed the total amount paid for the service in question.

 

 

11. LEGAL & DISPUTE RESOLUTION

This Agreement shall be governed by the laws of the State in which services are rendered. Any legal dispute arising out of or related to this Agreement shall first be attempted to be resolved through mediation, followed by binding arbitration if necessary. Both parties waive their right to a trial by jury.

 

 

12. ACCEPTANCE OF TERMS

By authorizing service or allowing our technician to access your property, you acknowledge that you have read, understood, and agreed to all the terms and conditions outlined in this Agreement. A copy of this Agreement is available upon request or may be viewed on our website at [www.zaptecs.com].
